If you are experiencing financial difficulties, you are not alone. Historically, over 1 million Americans have filed for bankruptcy in each recent year, as have thousands of businesses. Given our country's recent and dramatic economic downturn, we may well see that number increase dramatically in 2009.
Based upon my 13 years of experience with bankruptcy filings for individuals, relatively few cases are caused by an individual's poor financial decisions or irresponsible spending. Rather, the person or a family member usually has experienced an unexpected loss of employment, has incurred necessary but costly medical expenses, or has been led into a mortgage or other borrowing relationship that was at best never fully explained to the borrower or at worst actually mischaracterized by the lender. To this list of causes for filing bankruptcy we now can add the plummeting housing market, the marked nation-wide loss of jobs, and the collapsing stock market. In short, in most cases it is simply wrong to suggest that the individual had meaningful control over his or her financial situation and thus could have simply averted bankruptcy by making better decisions. Far, far larger forces have been operating to cause the bankruptcy.
I spend a significant amount of my time helping clients recognize that if they need to file bankruptcy, that doesn't mean they are bad persons or "failures"; I don't begrudge that time because I really believe that the need to file bankruptcy is visited upon many good and honest people due to circumstances beyond their control.
Unfortunately, filing a bankruptcy to ease one's financial situation can itself be expensive. In an effort to keep my overhead and your attorney fees low, I am now conducting my practice out of my home. I also depend quite heavily upon technology to keep my expenses low. As a result, I can continue to offer free initial consultations.
